Terms of Service

These Terms of Service (“Terms”) govern your access to and use of busysms.net, the BusySMS APIs, and the BusySMS mobile application (the “Service”). BusySMS is a service operated by EFIRITY PTE. LTD. (“BusySMS”, “we”, “us”). By creating an account, installing the app, or using the Service, you agree to these Terms.

1. What BusySMS is

BusySMS lets you run phones you own as your own SMS gateway. When you install the app, sign in, and turn a SIM on, the verification/OTP SMS that arrive on that SIM are captured so you can read them back through the BusySMS REST API or MCP. You pay a monthly subscription per active device (see section 6). BusySMS does not route internet traffic through your device.

2. Eligibility

  • You must be at least 18 years old (or the age of majority where you live).
  • You must use only networks and devices you are authorized to share.
  • You must not use the Service where prohibited by law or carrier rules.

3. Account & authentication

Accounts are created and accessed with a phone number and one-time SMS code (OTP). You are responsible for the security of your phone and for activity under your account. You may delete your account at any time (in-app, dashboard, or account-deletion).

4. Sharing & consent

  • Sharing starts only when you turn it on in the app.
  • A persistent notification is shown while sharing is active.
  • While sharing is on, the app processes incoming verification/OTP-style SMS only — not your personal messages.
  • You can stop sharing at any time from the app or notification.
  • You must share only a phone number you own and are permitted to use for this purpose.

5. Acceptable use

You agree not to use the Service to:

  • Violate any law, regulation, or third-party rights
  • Commit fraud, credential stuffing, spam, malware distribution, or phishing
  • Attack, scan, or overload networks without authorization
  • Circumvent security, rate limits, or abuse controls
  • Create multiple accounts to evade limits or manipulate metrics
  • Connect phones or SIMs you do not control, or use the Service to receive codes for accounts that are not yours to create or access
  • Resell or expose your gateway to third parties as a public service

We may suspend accounts, cancel subscriptions, or terminate access for abuse, fraud, or policy violations.

6. Subscription & billing

  • The Service is billed monthly per verified phone number on the account, by card through Stripe. Subscriptions bought through Google Play before card billing are still honored and are managed in Google Play. Current pricing is shown on the website and may change with notice.
  • A number counts as verified once it has been confirmed on your account. Dual-SIM with two verified numbers is two. Turning the gateway off does not stop billing that number.
  • New accounts start with a free trial. After it ends, a valid payment method is required to keep reading codes through the API/MCP.
  • Payments are processed by Stripe. You can cancel anytime from the billing portal; access continues to the end of the paid period.
  • If you invite others into your organisation, their devices bill to your subscription.

7. Privacy

Our Privacy Policy explains what data we collect and how we use it. By using the Service you also acknowledge that policy.

8. Intellectual property

The Service, branding, and software are owned by BusySMS or its licensors. You receive a limited, non-exclusive, revocable license to use the app for your own lawful use of the Service.

9. Disclaimers

THE SERVICE IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. We do not guarantee continuous availability, capture of every message, or that your carrier or device will permit running a gateway on every plan.

10. Limitation of liability

To the fullest extent permitted by law, BusySMS is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill. Our total liability for claims relating to the Service is limited to the greater of (a) the amounts you paid us for the Service in the 3 months before the claim or (b) USD $50.

11. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate access for violation of these Terms, legal risk, or extended inactivity.

12. Changes

We may update these Terms. Material changes will be posted on this page with an updated date. Continued use after changes means you accept the revised Terms.

13. Text Messaging

If you opt in to SMS at signup, BusySMS (EFIRITY PTE. LTD.) will send you one-time passcodes and account notifications. Message frequency varies; message and data rates may apply. Reply STOP to cancel or HELP for help. See our Privacy Policy for details on how phone numbers are handled.
